Januar 2022 ist der von Transparency International erstellte sogenannte Korruptionswahrnehmungsindex 2021 erschienen. Von den 180 bewerteten L\u00e4ndern belegt Deutschland im Index Platz 10 (abrufbar unter <a href=\"https:\/\/www.transparency.de\/cpi\/\" target=\"_blank\" rel=\"noreferrer noopener\">https:\/\/www.transparency.de\/cpi\/<\/a>).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Gleichzeitig mit der Ver\u00f6ffentlichung kritisiert Transparency International, dass die Korruptionsbek\u00e4mpfung in Deutschland kaum vorangeht. Im Fokus der Kritik steht eine fehlende Regelung zur strafrechtlichen Verantwortung von Unternehmen sowie die aus Sicht von Transparency International fehlende Wirkkraft vom \u00a7 108e StGB (Bestechlichkeit und Bestechung von Mandatstr\u00e4gern).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Entwicklung der letzten Jahre im Korruptionsstrafrecht<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Demgegen\u00fcber deuten die Entwicklungen der letzten Jahre bereits eine st\u00e4rkere Konzentration der Politik und der Strafverfolgungsbeh\u00f6rden auf den Bereich Korruption an. Am 1. Januar 2022 ist das Lobbyregistergesetz in Kraft getreten. Viele Staatsanwaltschaften haben inzwischen spezialisierte Abteilungen.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Koalitionsvertrag gibt Ausblick auf weitere \u00c4nderungen<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Im Koalitionsvertrag der neuen Bundesregierung deuten sich weitere \u00c4nderungen in dem Bereich an. Nachdem das erstrebte Verbandssanktionengesetz in der letzten Legislatur gescheitert ist, sieht der Koalitionsvertrag erneut vor, die Vorschriften zum Unternehmenssanktionsrecht und auch ausdr\u00fccklich zur Sanktionsh\u00f6he zu \u00fcberarbeiten. Unter dem Stichwort \u201eTransparenz\u201c ist zudem vorgesehen, den Straftatbestand des \u00a7&nbsp;108e StGB wirksamer auszugestalten. Transparency International fordert hierzu unter anderem die Ausweitung des Tatbestandes auf jegliches mandatsbezogene Handeln des oder der Abgeordneten und die Erfassung von im Nachhinein gew\u00e4hrten Nachteilen.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In den kommenden Jahren werden Unternehmen und Mandatstr\u00e4ger:innen sich auf Gesetzesversch\u00e4rfungen einstellen m\u00fcssen.
